A last will and testament is a complex and sensitive legal document that can take different forms, depending on state law. Some wills legally require notarization, some do not and may actually be invalidated if they are notarized. We will never offer advice on how to execute a will.

The Notary Public laws require notaries to take special precautions before notarizing documents.

We will refuse Notary Public service under the following conditions:

  • The signatory is not present in person at the time of appointment.

  • The document is either incomplete or incomplete.

  • The signer has been adjudicated, mentally incapacitated and has not been restored to capacity as a matter of record.

  • The signatory cannot provide an acceptable identification document; and / or the signatory cannot provide “two credible witnesses” to identify the signatory.

  • The signatory appears drunk, sedated or disoriented.

  • The notary knows or suspects the transaction is illegal, false or misleading.

  • The signer does not speak English and there is no one available to translate the document into a language the signer understands.

  • The notary believes the signatory is coerced or does not understand the consequences of the signature.

  • Signatories or witnesses do not agree to sign the document.

  • The document or form to be notarized must be completed in full.

  • We do not provide any forms, create any documents or help you fill in the document.

  • All signer(s) must be present at the time of the appointment.

  • All signatories must present an original photo ID that has not expired.

  • The signer(s) must be of sound mind, alert, and mentally competent.

  • The signer must want to sign the document being notarized.
